The Guardian Newspaper wrote:
1,000 New Zealanders have been deported by the Australian government under changes made to section 501 of the Migration Act in 2014. Even if they have lived and worked in Australia for decades and gained permanent residency, under the new rules New Zealanders can be ejected on “bad character grounds”, for being sentenced to 12 months or more in jail, or at the discretion of the home affairs minister, all in the name of national security.

Rebecca Powell from Monash University’s Border Crossing Observatory says New Zealanders now make up the majority of people held in Australian immigration detention centres, and are the largest nationality group to have their visas cancelled under the new amendments. New Zealanders of Māori and Pacific Island descent are over-represented

Sigh.

Princestamps - You are Irish when it suits you, and Maori when it suits you. Very handy.

The MONASH UNIVERSITY you should be directing your predicable rants at. And they were simply quoting FACTS.

If these 1000 Kiwi Maoris etc did NOT commit these very serious offences, they would not be getting deported back to their mates there. There is a thought to dwell on.

Blame their offences on MONASH UNIVERSITY or ‘’whitey racists’’ if you like. It will all be someone's else's fault of course. The Court system clearly disagrees with your childish summation however. You can have them back to keep breaking the law - over there.

For the record, what Waffle was referring to above was the High Court case of Love and Thomas, decided in the last few days.

New Zealand-born Brendan Thomas had lived in Australia since 1994 and is a descendant of the Gunggari people through his maternal grandmother. Thomas was detained in 2018 and had his residency visa cancelled after serving part of an 18-month jail sentence for a domestic violence attack. He also had further convictions dating back more than a decade.

Daniel Love is 40-year-old man, with a PNG mother and an indigenous father, and has lived in Australia permanently since he was five. His case is more complicated as the judges disagreed on whether he had been accepted as part of the Kamilaroi tribe - this part of his case will be subject to further adjudication. Love was detained in a Brisbane immigration detention centre before being released in September 2018 after he had served a 12-month sentence for assault occasioning bodily harm.

Neither man holds Australian citizenship, but both identify as indigenous, and each has one Australian parent.

The Court found (paraphrasing) that Brendan Thomas (born NZ) could not be deported as even though he was not born here, nor was a citizen, he had accepted Aboriginal heritage. Essentially, they could not be 'aliens' under the Constitution which meant, in practice, indigenous people were exempt from immigration laws. The case was decided 4-3 in a split vote, and is very controversial. Waffle was not making any racist comment, if that implication was taken from his post.

See a piece by Anne Twomey on the case, here:

Some of our Maori Bikie crims as you put it - were deported for not paying parking tickets.

People being deported after their jail sentence

Family break ups and pre dawn raids (Something we banned in the 1970s after botch ups and cases of 6 year old kids being left to fend for themselves).

http://theconversation.com/why-new-zealanders-are-feeling-th ... licy-99447

Yet I feel, they should not be there in the first place - We should all be looking after our own.

Glen - this rant has nothing to do with selective ethnicity - it comes out of my feelings as a human being (Perhaps some of you Aussies may suggest that only WASPS are people and we are some man/ape hybrid  - 30% of Trump voters believe that)

https://www.nytimes.com/2018/06/17/opinion/roseanne-racism-blacks-apes.html

As a human I have basic compassion towards everyone, Maoris, Indigenous peoples, Whites - but I have no compassion for people who go on hate filled rants over other people's skin.

Notice how no one has attacked Brierley for his ethnicity or supposed religion - because he is white, but say if he was Indian or Chinese or even Muslim, you would all be attacking his ethnicity too.

Remember your comments about Ahmed Fahour which focussed more on his Islamic faith than his misdeeds and the fact he was a "Lebbo".

Attack the person, not the crime.

No one has been deported from Australia for not paying parking fines.

The errant nonsense about parking fines continues to be promulgated, interestingly, only from NZ.

Correct - the 1000 Kiwis who have been deported, first needed to be "sentenced to 12 months or more in jail" as the article very clearly states.

The Courts do not care if they are white, brown, black or green skinned - if they go on rape sprees, or armed robbery with violence etc, they get sentenced.

No-one gets those long sentences for ''unpaid parking tickets'' and if the Kiwi Media reports that, they are dumber than widely believed. Near as dumb as any readers who believe such arrant nonsense - we have one above.

NZ clearly does not want these crims back, wreaking havoc back home, and continuing their crime sprees over there, hence their victim mentality, and as always with Kiwis, blame others.

NZ deserves them all back.

And to be fair, we should take back any Australian citizen residing in NZ who is sentenced to 12 months in prison in NZ.

Mind you, that populous group would not fill a phone box in South Auckland.

If you had that on a T-shirt, I'd be worried.

Did you mean "Attacking the person, not the crime"?

Generally, we address the crime, not attributes of "the life-form" in the dock.

No one should be attacking anyone.

Back on topic.

The Ron Brierley matter was back in court on 2 April 2020, for mention only. Brierly was not required to personally appear, due to the administrative nature of the listing, hence no media scrum.

The way things are this may not be heard until 2021.

Just noticed this post.

The life-form who thought massacring all those worshippers in Christchurch was a good idea called Australia home.

Can we send him back, ask the Australian Govt to make restitution to all his victims, and then leave him for your capable (coff, coff) politicians to keep him incarcerated for the rest of his life?

The principle may be valid - extending it to those who've lived in Australia since primary school is ethically dubious.

Maybe if we send him back, the Australians can send him to the hellhole of Nauru Island for his life term!

He would have pretty stamps to use on his mail, but would have to deal with a LOT of hostile fellow-inmates!

The principle should be consistent, deported at the end of his sentence.

And, for those who have been here since primary school, you have two choices, become a citizen or stay out of goal. It ain’t hard.

Ron Brierley's case in court on Thursday 6 August 2020. The matter will return to court on 17 September 2020.

Sir Ron Brierley case: Delay as detectives search 25,000 extra images for child abuse

New Zealand Herald, 6 Aug, 2020 7:37pm / Daily Telegraph

https://www.nzherald.co.nz/business/news/article.cfm?c_id=3&objectid=12354432

Detectives are poring through thousands of newly discovered images following the arrest of Kiwi businessman Sir Ron Brierley on child porn charges, a court has been told.

Brierley, 83, of Point Piper, was mentioned in Downing Centre Local Court on Thursday after being charged with six counts of possessing child abuse material.

The Kiwi-born retired multi-millionaire was arrested by police when he was about to board a flight to Fiji at Sydney airport last December after a tip-off to Crime Stoppers.

Police allege in court documents Brierley possessed photographs and videos of young girls aged between around 2 to 15 along with word documents of typed stories that spoke of the rape of children.

The court was told authorities had seized 20 electronic devices and had already sifted through more than 680,000 images to look for child abuse material after his arrest.

In court, prosecutor Kenny Ng asked for an adjournment because police needed more time to examine more computer files after at least 25,000 extra images were discovered in July.

"It's a matter that involves a very large amount of electronic material," he said

"I'm told by the (officer in charge) that there are another 44,000 photos that require analysis.

"I'm asking for eight weeks so that those materials can be extracted and analysed."

However, Brierley's defence lawyer Lisa-Claire Hutchinson said prosecutors could instead use a representative sample of the material seized to speed up the court process.

"No satisfactory explanation has been offered for the delay," she said.

"There is no complexity to the access of these devices, we're talking about USBs, tablets.

"The option was available to the prosecution to proceed on the basis of a representative sample and they have chosen otherwise."

Magistrate Michael Antrum questioned the delay but agreed to adjourn the matter.

"It's in circumstances where there is a substantial number of alleged images of child abuse material," he said.

"It surprises me that an individual review is taking place (of all the images).

"That's a matter of the discretion of the director (of the DPP) … I understand the time sought today in the scheme of things is not unreasonable."

The matter will return to court on September 17.

Police looked into the former Sydney Cricket Ground Trust board member and high-flying businessman after a tip to Crime Stoppers in mid-2019.

A passionate cricket fan, Brierley's wealth has been valued at over $100 million.

He was knighted in 1988 for his services to business.

I am not a betting man but strongly suspect that with all the delays from both sides of the legal table, that Sir Ron will be the late Sir Ron before his case ever gets to court.

With his wealth, if ever he has to face court, I suspect his side will be stacked with the best barristers that money can buy.
I prefer to collect UK, British Commonwealth esp Pacific area ( not excluding West Indies/Canada ) and Western Europe. At the bottom of my zone of interest is Eastern Europe and communist countries.

Sir Ron Brierley faces 8 more charges in Sydney case over child abuse material

New Zealand business tycoon Sir Ron Brierley faces eight more charges, bringing the total number to 14 for allegedly possessing child abuse material.

The 83-year-old multi-millionaire corporate raider was initially facing six charges after his arrest at Sydney International Airport on December 17 last year.

Today, New South Wales court staff confirmed to the Herald that Brierley faced the additional charges.

He is due to appear in Sydney's Downing Centre Local Court again in December.

Brierley's lawyer has earlier indicated he will defend the charges but not guilty pleas are yet to be formally entered.

Brierley, who is a chairman or director of numerous companies in Australia and New Zealand, was arrested as he was about to board a plane to Fiji.

After being stopped by Australian Border Force officers, his hand luggage was seized.

Police allege they found more than 200,000 images and 500 videos on Brierley's laptop and electronic storage devices that depicted child abuse material.

Court documents said the material allegedly showed "young girls aged between approximately two years to 15 years in sexually suggestive poses."

The arrest followed a five-month police investigation, reportedly sparked by an anonymous phone call last August.

Famed corporate raider Ron Brierley has had an additional three charges regarding alleged possession of child abuse material added to the 14 he was already facing.

Sir Ron, who was knighted in 1988, had the additional charges added by the Director of Public Prosecutions in December, but the new total of 17 charges only came to light on Thursday morning in his latest court hearing at Downing Street Local Court in Sydney.

The case will also face another delay – this time eight weeks. The matter will next be heard on April 4 before Local Court Judge and NSW Chief Magistrate Graeme Henson.

The delay was reportedly due to the DDP case officer assigned to the case being on long service leave.

Sir Ron was arrested at Sydney International Airport in December 2019 and originally faced six charges. At the time, NSW Police said Australian Border Force officers stopped the then-82-year old as he was preparing to holiday in Fiji.

“The man’s carry-on luggage was searched before the contents of his laptop and electronic storage devices were reviewed, which are alleged to have contained large amounts of child abuse material,” NSW Police said at the time of the arrest.

The number of charges Sir Ron is facing increased to 14 in November 2020, and finally now 17.

A court official said there had been no pleas at this stage. Sir Ron, now 83, remains on bail.

The New Zealand-born businessman was one of the Tasman’s most notorious corporate raiders in both countries, particularly through the 1980s, after the 1961 launch of his R.A. Brierley Investments.

Sir Ron has a home in Sydney’s elite suburb Point Piper, is a former chairman of the Bank of New Zealand and is a former board member of the Sydney Cricket Ground Trust.

New Zealand Herald wrote: Sir Ron Brierley's latest court hearing delayed as child abuse image charges grow to 17

Business tycoon Sir Ron Brierley now faces 17 charges relating to alleged possession of child abuse material, according to details revealed before the latest court hearing.

At Sydney's Downing Street Local Court this morning, the case against Brierley was adjourned for another eight weeks.

The delay followed an earlier request to allow police more time to examine more than 600,000 images, video and text files seized from Brierley.

At the time, the court allowed the delay while Brierley's lawyer argued that police should examine a sample of the files - rather than all the files - to press the case.

This time, the delay was linked to the case officer from the Office of the Director of Public Prosecutions (DPP) taking long-service leave.

The delay brought frustration in court today, with chief magistrate Judge Graeme Henson saying: "The court is being held hostage over the internal considerations of the DPP. Justice delayed is justice denied."

It was a delay described as "disappointing" by Brierley's lawyer, Lisa-Claire Hutchinson, who said it was "some concern to the accused" that the case had not progressed further and now was "without a case officer".

An examination of the court file of the case by the Herald today shows there are now 17 charges against Brierley. It's an increase on the 14 charges on the file in November, which itself was an increase on the original six charges filed against Brierley after his arrest in December 2019.

The latest charges to be filed against Brierley specifically reference the number of child abuse images allegedly found on individual devices. One charge accuses Brierley of possessing a single image found on a storage device. Two other charges alleged Brierley possessed "child abuse material being 4146 computer images" and "child abuse material being 8131 computer images" on separate devices.

Brierley was a giant of Australasian business for decades. He rose to prominence in New Zealand during the 1960s with a corporate raider approach that reshaped the modern business landscape and changed forever the national perception of wealth.

Shares in Brierley Investments were owned by one in 20 New Zealanders in the 1980s after a decade of success picking takeover targets rich in assets but poor in shareholder returns.

His ambition quickly grew beyond New Zealand and he split his time between the country of his birth and Australia, moving to exclusive Pt Piper and becoming feted among the elite new generation of wheelers and dealers who disrupted traditional business practice.

Brierley was knighted in 1988 while chairman of the Bank of New Zealand, acknowledging his business achievements and his philanthropic involvement in the community. Cricket, particularly, had been a long-time passion of Brierley and a sport into which he had poured money and support.

At one stage, Brierley Investments was among the largest - and possibly the largest - companies in New Zealand. In Australia, his corporate raider-style approach led to the transformation of companies, such as Woolworths, now a multibillion-dollar chain store.

Knowledge of Brierley's personal life is thin, with cricket and stamp collecting at its centre.

brierley 2.png

His arrest in December 2019 came as he prepared to board a flight to Fiji from Sydney.
Australian Border Force officers stopped Brierley after an anonymous tip to Crime Stoppers. A search of his laptop and electronic storage devices allegedly recovered 200,000 images and 500 videos depicting child abuse. The content included written stories about abuse of children.

Brierley has been on bail since his arrest, living at his waterfront mansion Wunulla, on Wunulla Rd, the centre of a community of multimillion-dollar mansions and apartments looking out onto Sydney harbour.

His bail conditions are sufficiently relaxed as to allow him to stroll nearby Double Bay and drive around Sydney's eastern suburbs. He was prohibited from international travel and required to surrender his passport.

No formal plea has yet been entered, but Brierley has indicated through his lawyer that he will plead not guilty.

Court documents said the material allegedly showed "young girls aged between approximately 2 years to 15 years in sexually suggestive poses".

At one stage, the prosecution told the court 20 electronic devices had been seized and forensic experts had sifted through more than 680,000 images to look for child abuse material after his arrest.

Last year, Brierley sold a three-bedroom apartment with floor-to-ceiling windows and sweeping views of Sydney's harbour. The apartment, which he bought for $1.5m in 2014, sold for $4.215m.

Famed businessman Sir Ronald Brierley pleads guilty to possessing child abuse material

Heath Parkes-Hupton
Court reporter

Millionaire businessman Sir Ronald Alfred Brierley has pleaded guilty in court to possessing graphic sexual images, with court documents saying they involved girls as young as two years old.

The charges that have now been withdrawn alleged the possession of tens of thousands more files discovered during the two searches, at the airport and at Brierley’s luxury home.

They allegedly included typed word documents “that spoke of rape of children”, court documents state.

The elderly knight’s barrister Lisa-Claire Hutchinson asked that he not be required to stand in the Downing Centre Local Court on Thursday “due to his age” as she entered guilty pleas to three counts of possessing child abuse material.

The Wellington-born former head of the Bank of New Zealand was knighted in 1988 and also served on the board of the Sydney Cricket Ground Trust.

Brierley will return to court on April 30, 2021.

Indeed, I completely agree and having a three year old granddaughter things like this make my blood boil.

But these things are not about any kind of sexual attraction, however perverted, but simply about POWER. And it takes the lowest, weakest type of bully to try and exploit that kind of power over a two year old. He is beyond contempt, so far beyond that any kind of human compassion is too good for him.

He should be crushed like the maggot he is - and if he ever crossed my path I would not hesitate to crush him slowly and painfully.

I agree 100%. Human rights should not apply to people such as these. Here in South Africa we have a very big problem with child rapes, even as young as babies.

In our case it is not really a power play, but rather that these contemptible "maggots" believe that having sex with a virgin will cure them of AIDS.

Dispute remains over Sir Ron's child pics

The facts of child abuse media crimes committed by New Zealand investor and corporate raider Sir Ron Brierley are still to be finalised, a Sydney judge has heard.

Brierley, who will be added to the NSW's child protection register, pleaded guilty to three counts of possessing child abuse material on April 1 after images were found on his digital devices.

Those pleas led NZ Prime Minister Jacinda Arden to immediately ask the local honours unit to consider stripping Brierley of his knighthood.

The Sydney District Court on Friday was told that most of the facts of his crimes are agreed but a few, narrow issues remain disputed.

But that will likely resolve before another sentence mention on May 21, the 83-year-old multi-millionaire's barrister Lisa-Claire Hutchinson said.

Brierley, who resides in Sydney's exclusive Point Piper, appeared in court via AVL from his barristers' chambers.

He was charged after police stopped him in Sydney International Airport and then searched his home in December 2019.

One admitted offence related to photographs of girls, aged as young as two years, in sexually suggestive poses while another concerned a data storage device found at his home that contained 1615 images of child abuse material.

Brierley rose to prominence in the 1970s with his eponymous company that, despite little starting capital, developed into an Australian-New Zealand conglomerate with investments in firms around the world.

It was at one time the largest company in NZ.

He was knighted in NZ in 1988, a year before standing down as head of Brierley Investments.

Brierley was a notable alumnus of Wellington College, where a theatre was named after him.

The school began scrubbing its grounds of his name after his guilty pleas on April 1.

Ron Brierley child abuse case: Disgraced millionaire surrenders knighthood

4 May, 2021 12:08 PM

Disgraced millionaire Ron Brierley has surrendered his knighthood.

NZ Prime Minister Jacinda Ardern this afternoon revealed that Brierley, who pleaded guilty to possession of child sexual abuse material, has relinquished his knighthood.

She said that if Brierley had not voluntarily relinquished the title, it would have been stripped from him.

Brierley was knighted for services to business in 1988.

He has been estimated to be worth $220 million.

Speaking to media this afternoon, Ardern said no matter someone's history, if they possess images which portray children being abused that "undoubtedly completely rewrites your history. Undoubtedly."

Brierley wrote to the Clerk of the Executive Council to tender his resignation as a Knight Bachelor.
Queen advised of forfeiture

"The Queen has been informed," Ardern said.

This means he's no longer allowed to use the title of "Sir" and he has been asked to return his insignia.

Officials wrote to Brierley on April 6, telling him he had 30 days to provide any information that he considered relevant before the Prime Minister made her decision.

Ardern said after he was notified the process was under way, Brierley resigned the title.

"But I'm very clear - had he [not] done so it would have been removed."

Last month, in an Australian court, Brierley pleaded guilty to three charges of possessing child sexual abuse

His barrister admitted he possessed "some images" but the exact figure is "in dispute".

According to the Guardian, he faces a maximum of 10 years in prison when he is sentenced.

He is 84 years old.

"I think it's a sad day for the children of New Zealand and, indeed, the world when someone is found guilty of possessing such horrendous images," Ardern said.

She added that it was only right that there are "significant consequences" for that.

As a country, she said, New Zealand has to reject anyone who thinks this is okay.

Wellington College, where Brierley attended high school, severed its ties with the disgraced businessman after his guilty plea.

Although the process of stripping a knighthood, or damehood, is not unprecedented, it does not happen often.

Albert Henry, the first Premier of the Cook Islands, lost his knighthood after he was forced to resign in a 1978 voting scandal for which he was later convicted of fraud.

Hugh Hamilton and Morgan Fahey also had honours removed - in each case having their appointments as Member of the New Zealand Order of Merit revoked.

A number of organisations are trying to figure out what to do with donations made by Sir Ron Brierley.

The 83-year-old former business high flyer pleaded guilty in Sydney last month to three charges of possessing child sex abuse material.

Herald senior reporter David Fisher says Cricket Wellington is one of the organisations working out what to do with the money.

He says some people think of the donations as tainted, while others believe his convictions shouldn’t detract from the good he has done in his past.

He says Wellington College and Cricket Wellington removed signage celebrating their links to the multi-millionaire, immediately after his guilty pleas.

Meanwhile, the Prime Minister's asked for the process to strip Brierley of his knighthood, to begin.

Absolute agreement Gavin.

I almost bought a rather costly stamp in one of his auctions, I now regret even bidding on the item.

Ron Brierley child sex abuse images case: What Brierley told police about images revealed

28 May, 2021 05:27 PM

Sir Ron Brierley has pleaded guilty to possession of child sexual abuse material at a Sydney court hearing.

WARNING: DISTURBING CONTENT

Ron Brierley told police officers quizzing him over a cache of images of naked children he had saved to several devices that the pictures were "all perfectly okay" and he had downloaded them because he thought they "looked interesting".

It can also be revealed that the items he was found with included two written documents relating to unconsensual and illegal sexual acts on minors. The 83-year-old former business high flyer pleaded guilty in Sydney last month to three charges of possessing child sex abuse material. In the wake of the plea, he has since lost his knighthood.

In December 2019, Brierley was at Sydney International Airport and due to fly to Fiji when he was stopped by Australian Border Force staff in the outbound examination area.

Brierley is set to be sentenced in August.

But on Friday afternoon the official Summary of Facts for the case was released by court officials in Sydney.

The document reveals the contents of an interview between a police officer and Brierley after police had located USB devices in his possession which had "a number of images and videos" on them.

"The offender was asked if he wanted to say anything and he said 'I reckon they're all, they are perfectly okay," the document stated.

"He said that they were freely available on the internet and 'they've been approved by various bodies'. He said he had downloaded the images from the internet."

He was asked about the documents in his possession and he said they were from an internet address and that they related to girls "on their various services". He said those services allowed him to subscribe and download the images.

"He was asked how old they were and he said "perhaps 8 to 12" and said "some of them are much older". He said the girls in the images and videos varied from 10 to 17 years. He later said the youngest was "probably about 8" and the oldest "19 or 20".

"He said he had last looked at the images the night before and looked at them for 'recreation'. When asked 'was it for a sexual purpose?' he said 'no'. He said he downloaded the images because they 'looked interesting'."

On one USB, police found "a Word document with writing detailing a sexual fantasy of sexually abusing an 11-year-old named Amanda and another document called "The Stepfather" detailing the sexual assault of a 9-year-old girl".

The document said Brierley had co-operated fully with the investigation.

When asked about the written stories which were stored as Word documents the Summary of Facts stated he said they had come via correspondence from America and "that he hadn't received any for a 'long time'. He said he received those documents by email. He admitted to having read the stories".

Some of the images had been downloaded the night before they were discovered by authorities, with Brierley saying he had looked at them for "recreation".

"When asked 'was it for a sexual purpose?' he said 'no'. He said he downloaded the images because they 'looked interesting'.

In total, 46,795 images found on the devices.

One was deemed 'category one': with the summary of facts describing that category as "an image depicting a real prepubescent child and the child is involved in a sex act, witnessing a sex act or the material is focused/concentrated on the anal or genital region of the child".

The rest deemed 'category two'; with the summary of facts saying that category could include those exposing genitals, or being in the presence of another person engaged in or apparently engaged in a sexual pose or activity.

Numerous photos featured young girls, some as young as four, in sexualised poses.

One folder - named 'Dream Models' - "contained images of a number of female children (of different ethnic backgrounds) who appeared between 5 and 8 years old wearing either underwear or crop top or swimwear".

The Summary of Facts added: "Many of the images depicted the children sitting, standing or posing in a sexualised way."

"In one video (the only video located which amounted to child abuse material, and which ran almost 2 hours, there were six young female children wearing swimwear with the video focusing on their breast and genital areas."

A further search of his Sydney home found thousands more images.

Earlier, a hearing at the Downing Centre court in Sydney heard that Brierley's sentencing would take place on August 20.

The three charges to which Brierley pleaded was down from the initial 17 charges laid by the prosecution. Throughout the course of the case, the court has heard frustration from his lawyers over the police's slow work in bringing to court analysis of the images seized.

Brierley's guilty plea followed his arrest in December 2019 after he was stopped at Sydney Kingsford Smith Airport.

He was preparing to catch a flight to Fiji when stopped by Australian Border Force officials, acting on a tip-off. They seized devices from Brierley, which were searched, and were followed by a further search at the nearby Mascot police station and his waterfront mansion.

One charge to which Brierley admitted identified the offending material as including images of children ranging in age from 2 to 15 years.

In the wake of his guilty plea, an inquiry was launched into whether he should be stripped of his knighthood. Before a decision could be made, Brierley voluntarily surrendered it.

Wellington College, which has benefited from Brierley's philanthropy, removed signage bearing his name from its facilities. Cricket Wellington, where Brierley had been patron, has said it is reviewing his status as a Life Member.

Brierley's bail has continued following his guilty plea, allowing him relative freedom to stroll nearby Double Bay and to be driven around Sydney's exclusive eastern suburbs. The Herald recently identified that Brierley still appeared to have internet access with an email emerging from him sent in February 2020.

The email, sent to Wellington College, said: "Ironically, of course, I'm exactly the same person as I have always been."

Brierley has been a towering figure in Australasian business. His rise began in New Zealand in the 1960s through identifying asset-rich companies that offered low returns to shareholders, staging raids and turning stagnant wealth into shareholder returns.

By the 1980s, Brierley had extended his business to Australia, and then on a global footing through the 1990s and onwards. In 1988, while chairman of the Bank of New Zealand, his contribution to business and philanthropy led to a knighthood.

He retired as a director from BIL in 2001 then from the chairman's role at Guinness Peat Group in 2010, bowing out as a director in 2015. In June 2019, he retired as chairman of Mercantile Investments, a Sydney-based boutique with $80m invested.

Why Ron Brierley is extremely unlikely to be deported as a 501 from Australia to New Zealand

Disgraced New Zealand-born businessman Sir Ron Brierley is extremely unlikely to become a 501 deportee after guilty pleas to possession of child sexual abuse material - because he is an Australian citizen.

Brierley, a Wellington College old boy, pleaded guilty to three of 17 charges during a Sydney court hearing yesterday morning. One charge to which Brierley admitted identified the offending material as including images of children ranging in age from 2 years through to 15 years.

Despite his offending, Brierley seems unlikely to be added to the hundreds of New Zealand-born Australian residents who have been deported from Australia to New Zealand for crimes committed - people widely known as 501s, the character section of the Australian Migration Act that allows the cancellation of their visa.

A person's visa can be cancelled or refused by the Australian Department of Home Affairs if it is believed they do not pass the character test. Any non-citizen sentenced to 12 months prison in Australian was subject to deportation - even if they served their time behind bars in the past.

Christchurch 501 advocate Filipa Payne explained Brierley wouldn't be deported as a 501 due to his citizenship.

"[Brierley] is an Australian citizen who can not be placed through the deportation regime, unless they revoke his citizenship," she said.

Payne speculated Brierley's citizenship would only be revoked if he was linked to terrorist activity, similar to 26-year-old Suhayra Aden who had her Australian citizenship revoked when her ties to terrorist group Isis came to light in February.

Hypothetically, Payne was confident if Brierley was not a citizen of Australia and merely a visa-holder, his crimes could warrant deportation.

Sounds like he had a rather complex background -

https://www.dailytelegraph.com.au/news/nsw/lady-mary-fairfax ... ba90a2f452

Lady Mary Fairfax clueless in love match for NZ tycoon Sir Ron Brierley

Lady Mary Fairfax worked hard during the 1980s to find a love match for Sir Ron Brierley, the New Zealand tycoon who last week pleaded guilty to possessing child abuse material.

Annette Sharp

The Sunday Telegraph

Lady Mary Fairfax — dubbed “Mad Mary”, “Meddling Mary” and, frequently in exasperation, “bloody Mary” during her four decades at the self-appointed centre of Australian society — worked hard during the 1980s to find a love match for Sir Ron Brierley, the New Zealand tycoon who last week pleaded guilty to possessing child abuse material.

Among the women she hoped Brierley might take a shine to was the then twice-married and twice-divorced Susan Sangster, ex-wife of politician Andrew Peacock who would later become Lady Susan Renouf.

Stories of the time recount Lady Mary’s frustration at being unable to find a wife for the wealthy, titled, yet unmarried Brierley, then a bachelor in his 50s who some suspected to be gay — though this would hardly be an impediment to marriage in Lady Mary’s eyes.

“I don’t feel matrimony is high on his agenda,” Lady Fairfax, who sat on one of corporate raider Brierley’s boards, told a journalist in 1993. “It’s not really a need of his. He has female friends but I can’t see him with a wife or children.”

Brierley, or “Bear” as some called him — perhaps because he once bid on a teddy bear at a charity auction — never did pursue Susan Sangster nor any of the other ladies Lady Mary had hoped might turn his eye.

“The domestic scene has never really appealed to me,” Brierley said some 30 years ago, trying to explain his uncommon bachelorhood.

His lack of interest in domesticity must, upon reflection, be something of a relief for Susan Sangster’s three daughters, Caroline, Ann and Jane. All were lovely young women when Lady Mary’s eye fell upon their mother.

Brierley last week faced a Sydney court pleading guilty to possession of graphic sexual images of girls as young as two years.

He was stopped by Australian Border Force officers at Sydney Airport in December 2019 on his way home from Fiji where an image of “child abuse” was found on a storage device.

A further search by the AFP allegedly found thousands of images of young girls “approximately between 2 years to 15 years of age in sexually suggestive poses” at his home.

If that revelation hadn’t removed Brierley from Lady Mary’s “single chaps” list, the news New Zealand Prime Minister Jacinda Ardern plans to strip him of his knighthood would certainly have given her pause.

The sexuality of the wealthy Brierley, who once helmed a company with over $3 billion in investments, has confounded his friends and associates for decades.

Apparently not even the revelation, made in 1990 by his biographer, that Brierley frequented Thai brothels where he favoured teenage girls was a red flag.

Brierley, a stamp and coin collecting nerd and cricket fan, taunted his biographer about his trips to Thailand: “You know how I like to visit the Buddhist temples …” he told her, a reference to the brothels she would say.

After quitting his native Wellington for Sydney in the ’60s, Brierley settled in Kings Cross where, for 12 years, the multi-millionaire lived in a shabby hotel room.

Eventually his associates persuaded him to splash out on a more respectable address, prompting his move into a refined harbourside address in Point Piper.

Brierley had long been plagued by gay rumours fanned in 1977 by his friend and countryman Sir Robert Jones, who told media Brierley was engaged to a well-known Wellington transvestite.

In later reports that transvestite would be identified as Carmen Rupe who, like Brierley, had swapped Wellington for Sydney and lived in the Cross.

Rupe, born Trevor Rupe in 1936 and a year older than Brierley, first moved to Sydney in the ’50s.

Here she made her name as a drag performer, brothel manager and HIV AIDS activist before returning to New Zealand and running for mayor in 1977.

She later moved back to Sydney and in 2008 and was celebrated by the LGBTQI community, who tapped her to lead the Decade of the Divas float at Mardi Gras on her mobility scooter. She died in 2011.

Once described by the mother he idolised as a “loner”, 83-year-old Brierley now faces an exceptionally lonely stint in jail.

Not that he ever seems to have had particularly grand plans for his retirement.

When once asked if he saw himself retiring on a yacht, he said that of his fantasies, “ … retiring on a yacht … is one of the more respectable ones”.

Jail 'likely' for Sir Ron Brierley

https://www.odt.co.nz/business/jail-likely-sir-ron-brierley

A forensic psychologist who has worked with some of Australia's worst sex offenders says Sir Ron Brierley is likely to be sentenced to prison.

The 83-year-old New Zealand businessman yesterday pleaded guilty in a Sydney court to three charges of possessing child sex abuse material.

Brierley, who lives in Sydney, was arrested in December 2019 for possession of child abuse material. Border officials had found child sexual abuse material on his laptop and electronic storage devices.

Forensic Scientist Ian Coyle said Brierley's crime was at the serious end of the scale.

"The mere fact that it's non-contact offending does not detract from the gravity of the offending," Coyle said today.

"Those who are purchasers of child pornography actively assist in the pornographic offending of those who take the images.

"There's no getting around that - it's not a victimless crime."

Coyle said people who viewed child pornography were twice as likely as sex offenders to reoffend.

I hope Brierley fries for what he did, 100 years jail, hard labour and no compassion for his health problems.

Greedy parasites like that need to be broken.

Well it appears Brierley might need to await his fate a little longer than August 20?

That date is my Birthday, and coincidentally, the first birthday of a very sweet little granddaughter. I was rather hoping to read Justice had been served. Hopefully the Judge has young grand-daughters. :!:

Ron Brierley's sentencing may be delayed due to COVID outbreak

New Zealand Herald business journalist
sam.hurley@nzherald.co.nz

Besmirched businessman Ron Brierley may have to wait to learn his fate after admitting charges of possessing child sex abuse material in Sydney.

The 84-year-old multi-millionaire and corporate raider is due to appear in court again on August 20.

However, the building has now been closed amid a devastating Covid-19 outbreak in Australia.

A statement on the New South Wales Bar Association's website said the Chief Magistrate's Office advised that, due to potential Covid-19 exposure within the Downing Centre Building, a decision has been made to close the court for cleaning.

All cases which were due to be heard have been delayed until August 20.

According to the New South Wales Court and Tribunal online registry, Brierley is still listed for sentencing on August 20.

In April, Brierley pleaded guilty to three charges for possessing some 46,795 images depicting child sex abuse material.

The Wellington-born Brierley, who founded RA Brierley Investments Ltd and later received a knighthood for services to business in 1988, was arrested while trying to board a plane to Fiji in December 2019.
Make it your business to know

Brierley surrendered his knighthood in May after his guilty pleas and Prime Minister Jacinda Ardern had asked officials to begin the process of stripping him of the honour.

Ardern told media offending such as Brierley's "completely rewrites your history. Undoubtedly".

His arrest followed a five-month police investigation, reportedly sparked by an anonymous phone call. After being stopped by Australian Border Force officers, Brierley's hand luggage was seized.

Police initially alleged they found more than 200,000 images and 500 videos on his laptop and devices showing child abuse material.

The former chairman of the Bank of New Zealand's charges grew to 14 and eventually 17 earlier this year before his guilty pleas saw 14 withdrawn by prosecutors.

A now-infamous businessman and criminal, whose net worth grew to more than $200 million, he remains on bail at his Point Piper mansion in Sydney's exclusive eastern suburbs.

Brierley sentencing: Businessman faces justice over possession of illicit child images

20 Aug, 2021 07:07 AM

https://www.nzherald.co.nz/business/brierley-sentencing-busi ... QVOOYWRQY/

Multi-millionaire Ron Brierley has a "disorder" that lies behind his attraction to young girls, a Sydney court hearing has been told during a sentencing hearing over his possession of illicit child imagery.

The corporate icon's lawyers told the court Brierley should be spared prison even as police prosecutors rejected claims he was unaware the child abuse images found on his electronic devices were illegal.

Brierley, 84, pleaded guilty to three counts of possessing child abuse material after he was found with thousands of images on computer hard drives.

Australian Border Force officers uncovered the images, mostly of children aged around 11 years old, in his carry-on luggage as he prepared to board a holiday flight to Fiji.

The prosecution at today's hearing call for him to be jailed and his lawyer asked for leniency. The sentence will be handed down in October and Brierley will remain on bail until then.

The Downing Street Local Court in Sydney was told Brierley's success brought fame and power but had also ensured his fall from grace was an extremely public affair.

His barrister, Tim Game, SC, said that Brierley had lost his knighthood, had his name "scrubbed" from cricket pavilions and become a social pariah.

Sentencing hearing hears how Ron Brierley has gone from highest respect to social pariah

Staff reporters14:37, Aug 20 2021

Former business high flyer Ron Brierley had gone from the highest respect to being a social pariah, his lawyer has told an Australian judge.

Australian judge Sarah Huggett heard sentencing submissions on Friday for the former Knight Bachelor who had pleaded guilty to three charges of possession of child abuse material.

Brierley, 84, and his lawyers and the Crown appeared in a virtual court for the hearing in Sydney.

Other charges he had been facing were withdrawn.

His lawyer said his fall from grace had been radical, with his name removed from things like cricket pavilions, schools and he had lost his knighthood.

He said it was a scrubbing out of all he had done in his life.

He argued for Brierley to get a community-based sentence rather than go to jail.

Brierley had been diagnosed with a hoarding disorder, which along with the material he was caught with included stamps and newspaper clippings.

“The doctor called him a shocking hoarder.”

He also outlined medical issues, severe coronary artery disease, deterioration in his mobility, along with vascular dementia.

“It wasn’t until after he was arrested and had treatment that he appreciated it was illegal or the seriousness of it.” the lawyer said of the offending.

He said there was no attempt to hide it, it was not behind passwords or encrypted.

“It was sitting on his dining room table at his home.”

The lawyer said it was not a culpability free zone but rather a lack of appreciation of the seriousness, which he now understood that it was a wrongdoing in a significant way.

The Crown said when the judge looked at Brierley’s good character it had to be seen through the lens of being a person who has for a lifetime harboured these feelings about young girls.

He had never acted on that, which was important to bear in mind, but it did say something about his character.

Brierley will now be sentenced in October.

Australian Border Force officials stopped Brierley from boarding a flight from Sydney to Fiji in December 2019 and found the cache of child sexual abuse material.

Brierley was born in Wellington and is a graduate of Island Bay School and Wellington College.

His company, Brierley Investments, was once New Zealand's biggest listed company. It is estimated one in every 20 Kiwis owned shares in the corporate raider, and it amassed Brierley a wealth consistently estimated at well over $100 million.

He was knighted in 1988. Following his April 2021 guilty pleas, he started the process to tender his resignation as a Knight Bachelor.

Wellington College, which had its Brierley Theatre and the Sir Ron Brierley Turf named after the old boy and benefactor, in April confirmed it had removed all signage relating to Brierley.

It was while at the school that he displayed his first signs of a career to come.

Brierley's keen eye for making a coin saw him publish a horse racing tip sheet as a teenager, and he went on to publish a further tip sheet on underperforming companies, before stepping up to launch his own investment company, RA Brierley Investments, in 1961.

Brierley Investments became a feared corporate raider in the 1980s, although businessman Bruce Judge, who worked with Brierley, told the 2008 documentary, The Boy from Island Bay, said the company's reputation for being ruthless was not completely correct.

"A lot of what we saw were companies that had nowhere to go, " he told the documentary.

In 1983, everyone could join the action after Brierley Investments listed in Australia, the United Kingdom and New Zealand. The following year it became the largest company by capitalisation in New Zealand, and was seen as a blue-chip asset in many portfolios.

At its peak, it had 160,000 shareholders and stakes in more than 300 companies here and overseas, and Brierley's success elevated him to rockstar status for many smaller investors.

By 1986, the company's value had soared to $10 billion, and it became a popular stock among the share clubs that were common at the time.

As well as his business interests, he was reported to be one of the world's biggest buyers and sellers of stamps, and was a keen supporter of cricket - Wellington's Basin Reserve used to have a Brierley Pavilion named after him. Last year, he was removed as a patron of Cricket Wellington.

He was honoured as a “business phenomenon” at the Wellington Gold Awards in 2008, with the awards description noting “his aggressive approach has become the norm, and the Brierley style – hard work and astute judgment, and a bit of nous – is now the textbook way to business success”.

Brierley sentencing: Businessman faces justice over possession of illicit child images

"Public recognition was a terribly important part of his own life and his image of himself," Game said. "The downfall has been complete to the point donations are not accepted or returned if given."

Game said Brierley had dealt with his attraction to prepubescent girls for many years and it was a "significant affliction" and "disorder" for the businessman.

"He has kept this to himself and has been troubled by it for a long period of time," Game said.

"Maybe because he's been forced to, he does appreciate the seriousness of the wrong done."

The court had previously heard Brierley believed the images were "perfectly okay", saying they were available online and he looked at them for "recreation".

Crown Prosecutor Sean Hughes urged Judge Sarah Huggett to reject any claim Brierley thought the images were legal.

He pointed to one specific, explicit image, saying "the high-functioning Mr Brierley" must have known it was illegal.

Brierley has sought permission to serve his time in the community on a release order.

The prosecution argued that jail was necessary to send a message to others that "real girls" were in the images Brierley collected.

"A message has to be sent to those in the community who sit in a darkened room with little fear of being caught that, if they are caught, they will be properly denounced," Hughes said.

"Not by being stripped of their knighthood but properly denounced by way of a meaningful, substantial penalty. They should expect a jail sentence, a heavy jail sentence."

Brierley's lawyers say he had suffered significant cognitive decline since his arrest in 2019 and he requires his vast resources to keep himself functioning.

He had the beginnings of dementia and vascular disease, Game said, and had moved away from positions of responsibility.

Brierley did not appear in the Sydney court in person - neither did any of the lawyers - because the city's coronavirus pandemic has forced all hearings to be conducted remotely.

Brierley pleaded guilty to three charges, down from the initial 17 charges laid by the prosecution. He was arrested in December 2019 after being stopped at Sydney Kingsford Smith Airport.

He pleaded guilty this year and an inquiry was launched into whether he should be stripped of his knighthood. Before a decision could be made, Brierley voluntarily surrendered it.

Wellington College, which has benefited from Brierley's philanthropy, removed signs bearing his name from its facilities. Cricket Wellington, where Brierley had been patron, has said it is reviewing his status as a Life Member.

While waiting on sentencing, Brierley has been bailed to his Pt Piper mansion on Sydney's waterfront. It has allowed him the relative freedom to stroll nearby Double Bay and to be driven around Sydney's exclusive eastern suburbs. The Herald identified Brierley as still having internet access after his arrest with the emergence of an email sent in February 2020.

In it, Brierley told Wellington College: "Ironically, of course, I'm exactly the same person as I have always been."

Brierley 'missed' illegal child images

The West Australian https://thewest.com.au/news/crime/brierley-missed-illegal-child-images-c-3733535

Disgraced multi-millionaire Ron Brierley has a shocking hoarding disorder which partly explains why he had thousands of sexually suggestive images of young girls, his lawyer says.

The elderly investor, who once chaired one of Australia's most valuable public companies and was knighted in New Zealand, is facing jail time after child abuse material was found in his luggage at Sydney Airport in 2019.

But imprisonment wouldn't be appropriate in this case, his lawyer said on Friday, describing how Brierley's public shaming had taken him from being held in the "highest respect to a ... pariah".

The NSW District Court was told that the 84-year-old's arrest was followed by treatment in which he became aware of the wrongness and illegality of having 40,000 images of clothed prepubescent girls in sexually suggestive poses.

He'd also been diagnosed with a hoarding disorder - "a significant affliction" and a "feature of his life".

Brierley had large collections of many things, such as newspaper cuttings and stamps, and had been described by one medical expert as a "shocking hoarder", lawyer Tim Game SC said.

"He has attempted to deal with that (disorder) in one way or another for a large part of his adult life," Mr Game said.

Judge Sarah Huggett said she didn't think the quantity of the illegal images could be equated to Brierley's disorder.

"But it appears to be an accumulation of material and a person who, in the fabric of his psyche, (collects things)," Mr Game said.

Brierley had told a medical expert he "missed the images" taken from him, the court was told.

That "candid" admission "perhaps ... points to the hoarding," crown prosecutor Sean Hughes said.

But Mr Hughes submitted the hoarding disorder had no meaningful connection in the offending.

The worst picture in the elderly man's collection - found on a tablet in his bedroom - was a naked girl on all fours.

Judge Huggett should not accept Brierley thought the image was "anything but illegal", Mr Hughes said.

He dismissed comparisons to fishers unaware of where fishing grounds ended or cases in which the child abuse material was made of computer-generated or photoshopped images.

"Here we have real victims, and many of them," the prosecutor said.

Jail was the only option for possessing child abuse images, particularly to send the necessary message to people "sitting in a darkened room" committing such crimes.

Brierley's term should, however, take into account his age, health conditions including dementia, and to a lesser extent, his public shaming.

As well as being stripped of his knighthood in April, Brierley's name has been scrubbed from cricket stands, a school and other places where he'd had a long association. Recent donations have either been rejected or refunded, the court was told.

Brierley pleaded guilty to three counts of possessing child abuse material in April.

Agreed facts detail that, when stopped at Sydney Airport on the way to Fiji in December 2019, the then-knight told police he thought the 11,000 images of girls in sexualised poses and in various states of undress were "perfectly OK".

Searches of his Point Piper home uncovered another 35,000 child abuse images on devices in his dining room, hallway and master bedroom - though prosecutors agree a "significant" number of images are duplicates.

A text file named "The Stepfather" detailed the sexual abuse of girls aged nine and 11.

Brierley, who remains on bail, is due to be sentenced in October.

Ronald Brierley: Disgraced businessman begs not to be jailed over child abuse material stash

Former knight and disgraced businessman Ronald Brierley has begged not to be sent to jail as it’s revealed what was inside his vile child abuse material stash.

Steve Zemek
NCA NewsWire

August 20, 20213:52pm

Disgraced former business titan Ronald Brierley says he did not know he was doing anything wrong when he amassed a cache of child abuse material as he asked not to be sent to jail, a court has been told.

However, the prosecution has attacked the 84-year-old’s suggestion that he did not know the images were illegal, pointing out he was found with a picture of a young girl exposing her genitalia.

The New Zealand-born corporate raider is facing up to 10 years in jail after being caught with a trove of child abuse images on his laptop when he was stopped at Sydney Airport in 2019.

Brierley has suffered a dramatic fall from grace since being charged, including being forced to forfeit his knighthood.

His barrister on Friday told a sentence hearing in Sydney’s Downing Centre District that Brierley had become a social pariah, including having his name scrubbed from public buildings and schools.

Tim Game told Judge Sarah Huggett that the ailing Brierley should not be sent to jail because of his health, detailing how he is suffering the onset of dementia and severe coronary artery disease.

Brierley was en route to Fiji when he was stopped by Australian Border Force officers on December 17, 2019.

They discovered a trove of 11,756 images of child abuse material on his laptop and two USBs.

He also had in his possession sexually explicit stories that described the abuse of children.

“I reckon they’re all, they are perfectly OK,” Brierley told officers, according to an agreed statement of facts.

He also added he looked at them for “recreation” and found them “interesting”.

When police raided his Point Piper home, they found a further 35,030 images of child abuse material on his laptop and USBs.

It’s not known exactly how many pieces of child abuse material were in his possession because many were duplicates that had been collected over many years.

Mr Game told the court that the former head of the Bank of New Zealand and ex-SCG Trust board member “should have known better”, but it was his belief that the images were not illegal.

That prompted a sharp retort from crown prosecutor Sean Hughes, who argued that Brierley should be sent to jail to send a message to those who “sit in dark rooms” viewing child abuse material thinking they do so with impunity.

“The possession of child abuse material is always wrong and in any circumstances it’s unlawful,” Mr Hughes said.
Ron Brierley being knighted by Governor-General Paul Reeves in May 1988. He has since forfeited the honour. Picture: Wikipedia.

“I submit that your honour would not accept that a high-functioning Mr Brierley did not know that the image of the pre-pubescent girl exposing her anus and genitalia in a sexualised pose was anything other than illegal,” he said.

The court was told that a majority of the images were on the lower end of seriousness.

Brierley had 49,795 images in his possession, with all, except one, being “category 2” images that depicted female children in clothing, swimwear or underwear in sexualised poses.

According to the statement of agreed facts, none of the images depicted cruelty, torture or the children engaged in sexual acts.

There was a single category 1 image of a naked child.

Mr Hughes said possessing child abuse material was “not a victimless crime” because it involved the exploitation of real young people.

Mr Game said Brierley would likely have to go into protective custody or an aged care facility if he were to be jailed, arguing a community corrections order to be served in the community should be imposed.

“Mr Brierley’s fall from grace has been radical,” Mr Game said.

“Among other things he lost his knighthood.

“Although he is a stoic individual. Although he appears to have outwardly taken it on the chin, public recognition was a terribly important part of his life and image of himself.

“The downfall has been complete and to the point donations were not accepted or even returned … He’s gone from a person who’s regarded with the highest respect to someone who’s a social pariah.”

Mr Game said Brierley had been diagnosed by two psychiatrists as suffering from a hoarding disorder that was connected to, and played a part in, his offending.

“He has been described (by his psychiatrist) as a shocking hoarder,” Mr Game said.

“He has large collections of other things like newspaper cuttings and stamps.”

Brierley did not give evidence during his 2½ hour sentence hearing on Friday, watching on from his barrister’s chambers via videolink.

Judge Huggett said she “does not know what the result will be” of her judgment and he could be sentenced to jail.

She ordered him to appear in person at his sentencing on October 14.

From the ABC - https://www.abc.net.au/news/2021-10-14/ron-brierley-sentence ... /100538294

Disgraced New Zealand businessman Ron Brierley has been sentenced to 14 months in prison for possessing tens of thousands of child abuse images and videos, completing his "radical" fall from grace.

Brierley was stopped at Sydney International Airport in late 2019 when attempting fly to Fiji for a holiday.

When a large collection of child abuse material was found on the financier's laptop and two USB drives, he told police it was freely available online and that he found the images "interesting".

"I reckon they're all, they are perfectly OK," he said in a recorded conversation.

Brierley said he last looked at the material the night before "for recreation", but initially denied it was for a sexual purpose.

Police found thousands more images on other devices at his home in Point Piper, a harbourside suburb of Sydney.

In total, there were 46,794 files, however the New South Wales District Court heard there was a significant amount of duplication.

The 84-year-old pleaded guilty to three counts of possessing child abuse material.

In sentencing, Judge Sarah Huggett today rejected Brierley's suggestion that he mistakenly believed the material was legal.

She said the children depicted were between the ages of four and 15, although most were 11 or 12.

"The offender has disclosed a lifelong obsession and sexual attraction to pre-pubescent girls and stated that he used the images to masturbate," she said.

Your source for this ''certainty''??

Despite his offending, Brierley seems unlikely to be added to the hundreds of New Zealand-born Australian residents who have been deported from Australia to New Zealand for crimes committed - people widely known as 501s, the character section of the Australian Migration Act that allows the cancellation of their visa.

''A person's visa can be cancelled or refused by the Australian Department of Home Affairs if it is believed they do not pass the character test. Any non-citizen sentenced to 12 months prison in Australian was subject to deportation - even if they served their time behind bars in the past.

Christchurch 501 advocate Filipa Payne explained Brierley wouldn't be deported as a 501 due to his citizenship.

"[Brierley] is an Australian citizen who can not be placed through the deportation regime, unless they revoke his citizenship," she said

Well if he is a citizen, he wont be deported.

Just odd that a knighthood in NZ would encourage him to revoke his NZ citizenship, unless he changed before the knighthood, but why knight a non citizen???

Here is a newsflash for you -- masses of Australians have another legal passport. Many 100,000s of them. This is known as ''DUAL CITIZENSHIP'' -- been around for a few 100 years.

Our 3 daughters also all have Italians ones despite none of them speaking a work of Italian, (but they get to vote in all Italian elections, the ballot papers for which are entirely in Italian!) and their children have also got Italian (=EU) full passports, despite neither parent being born in Italy, or ever visiting there.

Brierley will be going nowhere I'd suggest.

Seven months did seem very light to me too.

His lawyers appear set on appealing the sentence.

Seven months will be done and dusted before the appeal even gets looked at is my guess, given the Xmas/New Year one month break. And I recall that all sentences may be INCREASED on any appeal, if the Appeal Court feels inclined?

Some folks of a gambling penchant might be inclined to leave well enough alone. :!:

He had begged to be spared prison with his lawyers saying he was an elderly and unwell man.

The Daily Telegraph understands Brierley's legal team are already launching a challenge against the result in the NSW Court of Criminal Appeal.
